Phoenix criminal defense attorney providing effective representation in Misdemeanor cases

Misdemeanor charges in Arizona are heard by Municipal Courts or Justice Courts. The Court that hears your case will depend on where you were arrested. The maximum sentence for a misdemeanor offense in our state is six months. Greater offenses will be charged as a felony. Our state divides misdemeanor offenses into the following categories:

  • Class 1 Offenses – Punishable by up to six months in jail and a fine of $2,500
  • Class 2 Offenses – Punishable by four months in jail and a fine of up to $750
  • Class 3 Offenses – Punishable by a $500 fine and thirty days in jail

It must be remembered that an individual can face multiple criminal counts in one case. This means that one could face charges for multiple misdemeanors and/or felonies simultaneously.

The first step in a misdemeanor case is an arraignment at which the accused will enter a plea of “guilty” or not “guilty.” A trial date will be set and the defense lawyer will be given “discovery” by the prosecution. This is a collection of police reports, witness statements, and other information which the prosecution must disclose pursuant to Brady v. Maryland. Counsel will then conduct any necessary investigations and file any necessary Motions. If a favorable resolution cannot be reached with the prosecution then the case will proceed to trial. If one is facing a Class 1 offense then they will have the right to have their case decided by either a Judge or a Jury. Class 2 and 3 offenses will be decided at a bench trial. This process can be highly complicated and it is important that you have an experienced attorney assisting you.
