Woman and lawyer standing in front of judgeThis is the next post in my series on the handling of solicitation charges in Phoenix, Arizona. My last article discussed Arizona’s fines and penalties for solicitation. It is important to understand that the offense is not simply a “private matter” between two parties. It is a criminal charge which can result in fines, jail time, and a criminal record. In this post I will discuss another important topic – setting aside a conviction so that you may move on with your life.

I have previously discussed the requirements of setting aside Phoenix, Arizona convictions. These same requirements apply to misdemeanor convictions involving solicitation offenses. It is important to understand that you will not be eligible to set aside the conviction until you have completed all of the Court’s requirements. These include successfully finishing any term of supervision or probation, paying all necessary fines, completing any classes or community service mandated by the Court, etc. It is important to understand that you will not be eligible to set aside the conviction if the victim was a minor under the age of fifteen or, typically, if a sexual assault was somehow related to the offense.

People sometimes wonder whether they need an attorney to assist with the setting aside of their conviction. Those convicted of solicitation, or any other offense, do not technically have to have a lawyer in order to complete the process. Having counsel, however, can help to ensure that all of the necessary Court documents are properly completed, that everything is timely filed, and that all procedures are properly followed as your request moves its way through the system. Many people have their set aside requests denied due to improperly completed forms. Having counsel can help you ensure that everything is handled properly.

There are many benefits to setting aside a solicitation conviction. While it does not completely erase your criminal record, the set aside can go a long way towards helping you to pass a future background check and to secure employment. This can increase your earning potential and provide several other avenues for you in the job market.
